AHIP Applauds HHS Decision to Enforce Health Care Discrimination Prohibitions Based on Sexual Orientation, Gender Identity

WASHINGTON, D.C. – Matt Eyles, president and CEO of America’s Health Insurance Plans (AHIP), issued this statement today following an announcement by the U.S. Department of Health and Human Services (HHS) stating that, effective today, it will begin enforcing Section 1557 of the Affordable Care Act. Section 1557’s prohibition on discrimination based on sex includes discrimination on the basis of sexual orientation and gender identity:

Every American deserves access to high-quality, affordable health care, regardless of race, color, national origin, sex, gender identity, sexual orientation, age, or disability. Discrimination and inequality are wrong in any form. We applaud today’s announcement, which reinstates practices to ensure that everyone—including Americans who identify as members of the LGBTQIA community—has access to health care without any discrimination. Health insurance providers will continue to work with other health care leaders to eliminate barriers that stand between Americans who identify as a member of the LGBTQIA community and their better health.
